YotMerch Terms & Conditions

1. About YotMerch
YotMerch is a merchandise platform operated by EFX79 LLC, a Delaware limited liability company ("YotMerch", "we", "us"). YotMerch enables charter yacht operators and their crew ("Store Owners") to sell branded merchandise to guests and customers ("Guests") through custom online stores.
2. Acceptance of Terms
By creating an account or store on YotMerch, you agree to these Terms & Conditions. If you do not agree, do not use the platform.
3. Store Owner Responsibilities
As a Store Owner you agree to:
- Provide accurate business and banking information
- Ensure all content uploaded to your store (logos, images, text) does not infringe third-party intellectual property rights
- Comply with all applicable laws in the jurisdictions where you operate and sell
- Only sell merchandise that is legal in the jurisdictions you ship to
4. Taxes
Consumer sales tax / VAT: For orders shipped to the United Kingdom, the European Union, Norway and Switzerland, YotMerch calculates the applicable sales tax or VAT at checkout, shows it before payment, includes it in the order total, and is responsible for remitting it to the relevant tax authorities as merchant of record.
Your own taxes: You (the Store Owner) remain solely responsible for your own income, business and any other taxes arising from your earnings and payouts on the platform. YotMerch does not provide tax advice; please consult a qualified tax adviser regarding your obligations.
5. Print Fulfilment
Orders are fulfilled by Printful, a third-party print-on-demand provider. YotMerch acts as an intermediary between Store Owners and Printful. Product quality, production timescales, and shipping are subject to Printful's own terms of service. YotMerch is not liable for production defects, shipping delays, or fulfilment issues caused by Printful.
6. Payments & Payouts
Guest payments are processed by Stripe. Store Owner payouts are made via Stripe Connect (for supported countries) or Wise international transfer (for other countries). Payouts are subject to minimum amounts and processing times as displayed in your dashboard. YotMerch reserves the right to withhold payouts where fraud or a dispute is suspected.
7. Transfer Fees & Bank Charges
All commissions and sales commissions earned by Store Owners, crew members, and any other parties on the YotMerch platform will be paid via Stripe Connect (bank transfer) or Wise international transfer, as applicable.
Payments are made at the gross amount earned. YotMerch does not absorb, cover, or reimburse any fees charged by Stripe, Wise, intermediary banks, correspondent banks, or your receiving bank in connection with your payout. These fees are collected directly by the relevant financial institutions and are outside of YotMerch's control.
This includes but is not limited to:
- Stripe payout fees or currency conversion fees
- Wise transfer fees and foreign exchange margins
- Intermediary or correspondent bank fees (which can range from $15–$50 per transfer for international wire payments)
- Incoming wire fees charged by your receiving bank
- Currency conversion fees applied by your bank
YotMerch does not know in advance what fees your bank or intermediary banks will deduct from your payment. We are not responsible for any fees deducted by financial institutions before funds reach your account. The amount you receive may be less than the commission shown in your YotMerch dashboard.
By accepting these terms, you acknowledge and accept that bank and transfer fees are your responsibility and will not be reimbursed by YotMerch.
8. Identity Verification
Store Owners receiving international payouts via Wise are required to complete identity verification through Didit, a third-party KYC provider. YotMerch does not store identity documents — these are handled by Didit in accordance with their privacy policy.
9. Prohibited Use
You may not use YotMerch to sell counterfeit goods, infringing content, illegal products, or anything that violates applicable law. YotMerch reserves the right to suspend or terminate any store at its sole discretion.
10. Limitation of Liability
To the fullest extent permitted by law, YotMerch and EFX79 LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability to you shall not exceed the commissions paid to you in the 30 days prior to the claim.
11. Changes to These Terms
We may update these terms at any time. Continued use of YotMerch after changes are posted constitutes acceptance of the updated terms.
12. Governing Law
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
